There are several factors that render a crime "violent." The prosecutors sometimes consider the following factors when charging a defendant with a violent crime:

  • If the crime was intentionally committed. Generally, intentional murder or assault is going to be charged as a more serious offense. Likewise, a more serious punishment will be imposed if a person is found guilty of an intentional assault or murder.
  • If a firearm was used during the commission of the crime. The use of a weapon during a burglary, robbery or other violent crime may result in an increased sentence if there is a conviction.
  • The degree and type of injury suffered by the victim. Generally the more serious the injuries, the more serious the criminal charges and potential consequences if convicted.
